Terms of Sale
Last updated: November 5, 2026. These terms govern every purchase of artwork offered on this site by OVERPRICED ("OVERPRICED", "we"). By buying, reserving or registering you accept them.
1. The works
- Every work is an original, one of one (1/1) piece. No copies, prints or editions are made.
- Works are sold by OVERPRICED as agent for the artist under a consignment agreement. 25% of the price goes to the artist and 75% to OVERPRICED.
- The price of each work is set by the OVERPRICED price roulette during the episode. It is the OVERPRICED price, not a professional appraisal.
- Works are not sold as investments. We make no promise that any work will keep or increase its value, and no work is sold in fractions or shares.
2. Prices, taxes and duties
- Prices are in US dollars. Sales tax is added when required by law, for example when the work is delivered in California.
- Shipping, insurance, import duties, VAT and customs fees in the destination country are paid by the buyer unless agreed otherwise in writing.
3. Payment
- Works up to US$50,000 may be paid by card through our payment processor.
- Works above US$50,000 are reserved with a deposit and paid by bank wire transfer or through a licensed escrow service, after identity verification.
- Wire instructions are only valid when they appear on a signed OVERPRICED invoice and are confirmed by phone. We will never change bank details by email.
- A work is delivered only after the full payment has cleared. We do not accept cash for works above US$10,000.
4. Identity verification and sanctions
- For every purchase above US$10,000, and whenever we consider it necessary, the buyer must provide a government ID, address and, for companies, the beneficial owner. Payment must come from the buyer's own account.
- We screen buyers against US sanctions lists. We do not sell to sanctioned persons, and we do not sell or ship to Cuba, Iran, North Korea, Syria, Russia, Belarus or sanctioned regions of Ukraine.
- We may refuse or cancel any sale, with refund of amounts paid, if verification is not completed or the sale may break the law.
5. Public and incognito purchase
- Public purchase: the buyer authorizes OVERPRICED to display their name and photo on the site as the owner of the work. The buyer may ask us to remove them later.
- Incognito purchase: the buyer's identity is never shown publicly. OVERPRICED still verifies the buyer's identity privately. Within 60 days of delivery the buyer sends a photo or video of where the work is placed, which OVERPRICED may publish after removing anything that identifies the buyer or the location.
6. Title, risk and delivery
- Ownership passes to the buyer when full payment has cleared. Risk of loss passes when the work is handed to the carrier or collected at the studio.
- International shipments are made with a fine art carrier. Works containing batteries or electronics may need special handling or battery removal.
7. Certificate of authenticity
Each work comes with a signed certificate of authenticity with its piece number, artist, date, materials and a code linking to its page on this site.
8. Copyright and artist rights
The buyer owns the physical work. The copyright stays with the artist, and the buyer may not reproduce the work commercially. Under US and California law the artist may object to the destruction, mutilation or alteration of the work. OVERPRICED may keep using images and video of the work for the show and its promotion.
9. Third party brands
Some works are made on branded objects. Those brands are not affiliated with and do not endorse OVERPRICED or the artists.
10. Law and disputes
These terms are governed by the laws of the State of California, USA. Disputes will be resolved by binding arbitration in Orange County, California, except where the law of the buyer's country does not allow it.
